Terms of Service

The following information outline the terms and condition of using any services we provide, including the VUG App on iOS and Android (The Services). The terms form a legal contract between you and the GiveVUGS Corp. (The Corporation), so please read carefully. By using the VUG app, or any of our other products or services linked to the Corporation, you agree to accept our Privacy Policy and Terms which are presented to you when you first install the App.

User Rights

The Corporation grants you a personal, royalty-free, non-assignable, non-exclusive, revocable, and non-sublicensable license to access and use the Services. You may not copy, modify, distribute, sell, or lease any part of our Services. Nor may you reverse engineer or attempt to extract the source code of that software.

Our Rights

By using our services, you may store/ create content such as VUGS and share them with other users and groups. Our standing policy is that the content in group and personal communication is private (eg. VUGS, pictures, videos, texts) and we will not access or review such information. In order for us to provide services, we will access user profile information you provide to us, and other app usage information.

Information shared with the public on the community walls, or other public forums become public data and you grant us and our affiliates the free unrestricted, worldwide right and license to use such content for purposes including but not restricted to promotion and advertising.

The services may contain advertisements. However, we will strike a balance between user privacy and the information needed by advertisers needed to show interesting material.

Keeping it Fun

VUGS is about bringing people together in a fun and safe environment. Your agree not to use the services to:

post offensive, illegal or adult content such as pornography, graphic violence, threats, hate speech, or incitements to violence.
harass, bully or defame other users
plan or carry out illegal activities
spams or solicits our users
use automated means to access the services or to perform any malicious activities that could be harmful to our users, our App, our systems, our networks, or our Brand.

Respecting Copyright

We respect copyright laws including the Digital Millennium Copyright Act. When notified of a violation, we will take reasonable steps to remove infringing material. Users with repeated violations could result in termination of services.

Disclaimer, Liability, and Indemnity

You are responsible for any mobile or data charges incurred in using our services.

The Services are provided “as is” and “as available” and without warranties of any kind, either express or implied, including, in particular implied warranties, conditions, or other terms relating to (i) merchantability, satisfactory quality, fitness for a particular purpose, title, quiet enjoyment, non-infringement, or (ii) arising from a course of dealing.

The corporation takes no responsibility and assumes no liability for any content that you, another user, or a third party creates, uploads, posts, sends, receives, or stores on or through our Services. You understand and agree that you may be exposed to content that might be offensive, illegal, misleading, or otherwise inappropriate, none of which the Corporation will be responsible for.

You agree to the extent provided by law, to indemnify, defend and hold harmless the Corporation, our affiliates, directors officers, stockholders, employees, licensors, suppliers, and agents from and against any complaints, charges, claims, damages, losses, costs, liabilities and expenses (including attorney’s fees) due to, arising out of the use of our services.

The Corporation, our affiliates, directors, officers, stockholders, employees, licensors, suppliers, and agents will not be liable for any indirect, incidental, special, consequential, punitive, or multiple damages, or any loss of profits or revenues, whether incurred directly or indirectly or any loss of data, use, goodwill or other intangible losses, resulting from the use or the inability to use our services.

Jurisdiction

By using our services, you agree that all claims and disputes related to these terms will be settled under arbitration in the jurisdiction of Alberta, Canada. If you do not agree, you must not use the services.

Privacy Policy

Overview

We value your trust and your privacy. Here are our key principles when it comes to Privacy.

We will communicate honestly and plainly.

You are in control of the things your keep private and the things you share.

We will protect and handle your data with care.

We believe that the content of private messages and multimedia between users and groups should be private and off-limits to GiveVUGS, third parties, and advertisers.

We will use various App information in order to provide the best user experience. For example, this may include location data, app usage data, app crash data, statistics on what features are most used, or which user in your group didn’t engage today so Vuggie can do his magic.

We envision the public community areas of VUG (eg. Community wall) to be an inviting and fun environment for all users. For this reason, common community areas will be monitored for bullying or offensive content will be removed based on user reporting. Repeated violations of this rule can be considered terms for service termination.

Information we collect and how we use it

When you use VUG, you provide certain information to us so that we can provide services to you. This includes profile information such as username, email, phone number, profile picture, and birthday along with a physical address if you purchase physical goods. Financial information you input into the app are stored/ processed via a secure well-known US-based 3^rd party payment processor. We do not collect or store user financial data. You also provide email and phone contact information directly or via a device contact book to invite friends/ family to join you on the platform. When you use our servers to chat with friends and family, the information is transmitted to us in encrypted form. VUGS utilizes 256-bit forward racheting encryption so that only you and your chat members can open the messages. When you send multimedia info such as pictures, videos, and VUGS to our servers, the App will access your photos/ videos/ camera. Once transmitted to our services, the media access is restricted to your group, unless you decide to share your creation on our community wall, in which case the information will be shared with the VUG app community.

In order to improve our services and for it to provide personalized services such as recommendations to help you improve your relationships, the app will collect information such as how you interact with the App, features such as filters/ stickers/ VUGS you like to use, and group interaction data such as when messages and VUGS were sent, etc.

We collect device information such as DeviceID, hardware model, operating system version, advertising identifiers, language, battery levels, timezones for general app functionality. VUGS Virtual hugs may include the usage of different sensors on your device as a sender or a recipient depending on the type. Phone sensor info such as accelerometers, gyroscopes, GPS, etc may be collected. Information such as general location may be used to identify the available gifting options shown in the VUGS app.

In order to keep providing our services for free to our users, we may show you advertising or promotions from 3^rd party advertising networks. We will access your Advertising ID to show information that may be most relevant to you. In this context, we may provide some usage information to 3^rd party advertisers and advertisers may share information with us as well. The overall objective is to show more relevant ads that you may be interested in.

Information that is disclosed

Profile information such as your username, profile picture, phone number or email may be disclosed to your other group contacts. Your group contacts will also have access to any messages and media (pictures, videos, VUGs) send by you.

Any information shared by you on the community page becomes public information and may be accessed by other users, and the general public. Prior to sharing, you may choose to send anonymously in which case the creator of the VUG will not be shown.

Information collected from your devices such as general location, usage information, and others may be used by VUGS to provide personalized services. Your device and advertising ID, and usage data may also be shared with 3^rd party advertisers to provide more relevant ads that you may be interested in.

VUGS reserves the right to share information about you for legal, safety, and security reasons. We may share information about you if we believe that is required to comply with a legal order, police or government request, investigate a potential violation of our Terms, protect the rights and safety of our users, or detect any fraud or security concerns.

Retention Policy

Due to the large amount of multimedia data retained and processed by our servers, our current data policy (subject to changes in the future) is to retain the information at least for 30 days on our servers. The App will automatically download and cache such information on your mobile device.
